General terms and conditions of sale - Bachelorsbooking

"Bachelorsbooking.com" or the "Website": refers to the website accessible at the address www.bachelosbooking.com , on which the Institutions may use the Services.
 
"Services": refers to the services provided by Eduniversal to the Institutions on the Bachelorsbooking.com Website, allowing them in particular to consult application forms, then to contact these applicants within the framework of the selection process.
 
"Applicants": refers to any physical person, student or professional resuming training, looking for training at the level of a Bachelor's, who is in the Bachelorsbooking database following application files or applications being transmitted via the Website.
 
"Institution": refers to any Bachelorsbooking client Institution or university that uses the Services, in particular, to consult the application files of Applicants within the framework of a recruitment drive.
 
"Users": refers to any user of the Services and of the Website, whether Applicants or Institutions.
 
"Account": refers to the individual account of each User, enabling him or her to connect to his or her personal space on the Website with a personal and confidential username and password and to use the Services reserved for Users holding an account.
 
"GTCS": refers to these general terms and conditions of sale. These general terms and conditions of sale shall be exclusively applicable to Institutions located within the European Union.
 
"GTCU": refers to the general terms and conditions of use.
 
 
1. Contract
 
These general terms and conditions of sale set out the rights and obligations of the parties in the framework of the online sale of applications to students who have created an Account on Bachelorsbooking. They complement the general terms and conditions of use (GTCU) which are applicable to all Users.
The GTCS are available to be consulted by every Applicant and Institution prior to the creation of an Account. Using the services offered by Bachelorsbooking constitutes acceptance of our general terms and conditions of sale and regulations.
 
 
2. Invoicing and Methods of Payment for Institutions
 
All invoices are subject to VAT at the applicable rates established in accordance with the contract between Eduniversal and the Establishment. The Establishment agrees to honour the payment terms defined in the contract.

 
3.1 Invoicing and Methods of Payment for Applicants
 
The Applicant may buy a predetermined number of applications in addition to those on offer.

  • The first 3 applications made by the applicant shall be free of charge.
     
  • The purchase of an additional application shall be at the cost of 22 Euros.
  • The purchase of 2 additional applications shall be at the cost of 40 Euros.
  • The purchase of 5 additional applications shall be at the cost of 80 Euros.
  • The purchase of 7 additional applications shall be at the cost of 120 Euros.

 
These are the prices initially set by Eduniversal; however, they may change in the event of temporary special offers which shall be posted on the website.
Payments shall be made by means of a payment card or via a PayPal account. The payment cards which are currently accepted are: CB, Visa Electron, Visa, Mastercard, Maestro, American Express, E-Carte Bleue.
 
It is the Applicant's responsibility to register and print its payment certificate if it wishes to retain its bank details.
 
 
3.2 Duration of the Offer
 
These general terms and conditions shall apply throughout the entire duration of the online availability of the Services offered by Bachelorsbooking on the website www.bachelorsbooking.com.
 
 
3.3. Applicant's Right of Withdrawal
 
In accordance with Article L.121-20-12 of the Consumer Code, the Applicant shall have a period of fourteen (14) calendar days from acceptance of the offer to notify Eduniversal that it wishes to withdraw.
In the event of the right of withdrawal being exercised, the seller shall make every effort to reimburse the consumer within a period of thirty (30) days.
 
The Applicant must then notify its wish to withdraw by means of the dispatch of a registered letter with proof of receipt to Eduniversal, located at 20 ter, avenue de Bezons - 92400 Courbevoie.
 
 
4. Amendments to the GTCS
 
Bachelorsbooking reserves the right to amend the GTCS at any time. Every amendment shall take effect from the moment it is enacted on the Website. The Applicant and Institutions shall be notified about any amendment made to the website. The GTCS applicable to an order shall be those in effect at the time when the Applicant placed the order.
 
 
5. Liability
 

  • OF THE APPLICANT

 
The Applicant undertakes to convey in good faith truthful information to the Institutions; should this not be the case, it shall be liable, in particular if the information conveyed is of such a nature as to deceive the Institutions and does not reflect reality.
 

  • OF THE EDUNIVERSAL COMPANY

 
The products and services offered on the Bachelorsbooking website shall fall under the sole responsibility of the advertiser.
 

  • OF THE INSTITUTIONS

 
The Institutions undertake to use the services and products to which they have access in an appropriate manner and without abuse. Any abusive and inappropriate use of the database containing the application files placed at its disposal shall result in the cancellation of the service and the temporary or definitive withdrawal of their access.
 
In the event of a complaint, claim, legal action or outstanding debts of an Applicant or third party, including CNIL or any judicial authority, indicating that the Institution has violated its rights, engaged in misconduct, violated a legal or statutory provision, or has caused it damage, the Institution undertakes to fully ensure and guarantee Bachelorsbooking and indemnify it for any fees, damages, interest, fines, indemnities, transactions and legal fees that it might have to pay in this regard.
 
 
Limitation of Liability
 
Eduniversal shall only be bound by an obligation of means and does not offer any guarantee that the application files conveyed will be suited to the Institution's needs. It cannot in any circumstance be held liable if the Applicants pertaining to the application files downloaded by the Institution do not match its needs or prove to be unsuitable.
 
Bachelorsbooking does not provide any guarantee related to the information conveyed by Users, in particular that contained in the Applicants' application files. It cannot be held liable in this respect, particularly in the event of inaccurate or outdated information.
 
The Institution is solely liable for assessing its needs and is the sole recruitment decision-maker, to which end it must satisfy itself of the suitability of applicants whose application files are downloaded from the Website.
 
Bachelorsbooking may not be held liable in the event of misconduct, error, imprecision, or negligence on the part of the Institution in particular in the definition of its needs or of its contractual, legal, and statutory obligations with respect to Bachelorsbooking, Applicants, or third parties.
 
Under no circumstances shall the Eduniversal company be held liable in the event of any improper use of Bachelorsbooking by the Institution, or of non-compliance with the instructions and directives provided by Eduniversal.
The Eduniversal company shall not be held liable in the event of any problems with data transmission, connection, or network non-availability, nor of speed of access or of any malfunction in the Internet network, taking into account any congestion in worldwide networks.

 
6. Intellectual Property
 
Applicants' files and the information they contain, provided from the Bachelorsbooking database which is protected by the Intellectual Property Code and for which Eduniversal holds the database producer rights.
 
These terms and conditions do not endow the Institutions with any rights related to copyright, trademark, or any other intellectual property right connected to the Website, other than rights of use limited to the service which is the purpose of its contract. Furthermore, every announcement or product published on the Website and all of their components as well as all associated intellectual property rights are and shall remain at all times the property of Bachelorsbooking.
With the exception of what is permitted by law, the Institution agrees not to copy, amend, or compile all or part of the Website.
The Institution hereby undertakes to compensate Eduniversal for any loss in the event of the infringement or breach of any intellectual property right which results from non-compliance on its part of these general terms and conditions of use of the Website.
 
7. Personal Data and Confidentiality
 
Application files contain personal information concerning the Applicants. Bachelorsbooking and the Institutions undertake to comply with the respective legal and statutory obligations incumbent upon them and, in particular, all of the provisions of the Data Protection Act of 6 January 1978.
 
The Institution undertakes in particular to notify CNIL of the processing of this information and to ensure the protection, confidentiality, and security of the information contained in the application files by taking all appropriate steps to avoid these data being altered or accessed by an unauthorised third party.
 
The information contained in the application files is confidential and may not be used by the Institution for any purpose other than its own internal recruitment needs, to the exclusion of any other use. It is strictly prohibited to convey all or part of this information to a third party without the prior, express consent of the Applicant and the Eduniversal company.
 
 
8. Complaints
 
Any complaint concerning any deficiencies or errors in the operations undertaken by Eduniversal on behalf of the Institutions or in the dispatched invoices must be conveyed in writing within 8 days following the discovery of the deficiency or error and within a 14-day period from conclusion of the aforementioned operations. The client must make its complaint in as detailed a manner as possible in order that the Eduniversal company may address the matter appropriately.
In the event of a justified complaint, Eduniversal shall fulfill its tasks, as set out under the contract, unless these are no longer relevant for the client. In this event, the latter party must notify Eduniversal.
 
 
9. Applicable Law - Jurisdiction
 
These general terms and conditions of sale in French shall be performed and interpreted in accordance with French law.
In the event of any dispute, the Applicant shall, in the first instance, liaise with Eduniversal in order to seek an amicable solution. In the event of failure to resolve the disagreement amicably, the matter in dispute shall be subject to French law and any dispute between the parties to this contract shall be referred to the exclusive competence of the Commercial Court of Nanterre.
